Welcome to Luxie Sites ("we," "our," or "the Company"). These Terms and Conditions (the "Terms") govern the provision of all web design, development, and related services by Luxie Sites to our clients ("you" or "the Client"). By engaging our services, remitting payment, or submitting a project brief, you acknowledge that you have read, comprehended, and unequivocally agreed to be bound by these Terms in their entirety.

Luxie Sites is a premium web design and development agency operating under the direction of Piyush Arya, based in Dehradun, India. We are proud to extend our services to clients both domestically and internationally.

These Terms represent the entire agreement between Luxie Sites and the Client concerning the subject matter herein, superseding any and all prior communications, proposals, representations, or understandings, whether written or oral.

Luxie Sites delivers premium website design and development solutions structured across the following service tiers. To ensure meticulous alignment with your objectives, every project commences with a comprehensive consultation call to define the scope and requirements prior to the initiation of any development work.

Important Notice: The prices detailed below strictly represent the initial downpayment required to secure your consultation call and book your project into our schedule. They do not represent the total or final price of the web design service. The comprehensive service cost will be formulated as a custom quote, meticulously catered to your exact needs and requirements defined during the consultation.

The source code for the website is exclusively included within the Studio tier. For projects executed under the Core, Professional, or Elite tiers, the source code may be acquired for an additional one-time fee. Please direct all related inquiries to hello@luxiesites.com.

All project pricing is formalized through a tailored contract. Payments may be securely processed via our integrated payment gateway (Razorpay) or, where feasible, rendered in person. Upon execution, the Client shall receive a comprehensive contract alongside an itemized invoice.

For our international clientele, exact payment modalities and applicable currencies shall be mutually agreed upon prior to project commencement and explicitly stated in the project proposal. International transactions are typically processed via our website's Stripe integration or through PayPal.

Luxie Sites strictly enforces a transparent, milestone-driven refund policy commensurate with project progression. The eligibility for, and the quantum of, any refund is intrinsically linked to the developmental stage achieved at the time a formal cancellation request is tendered.

Please note that consultation fees and initial mockup drafting fees are strictly non-refundable under any circumstances.

Depending on the selected service tier, your package incorporates a predetermined number of complimentary revision rounds. A "revision round" constitutes a singular, consolidated compilation of feedback provided by the Client, which Luxie Sites subsequently addresses in one comprehensive update cycle. These revision rounds are non-cumulative and strictly bound to the timelines outlined within the initial project scope.

Any feedback or requests that materially deviate from or expand upon the originally agreed project scope—such as the addition of extraneous pages, conceptual overhauls, or the integration of unspecified functionality—will be classified as a "Change Request." Such requests are subject to discrete, supplementary invoicing.

Post-delivery technical support is available as a supplementary service module, which may be established during initial consultations. Upon final delivery of the project, clients are granted a definitive two-week "cooldown" window wherein support packages may be retroactively appended. Any support inquiries received post-cooldown, absent an active retainer, will be categorized and invoiced as independent revision requests.

We optionally provide a monthly maintenance retainer, quoted dynamically based on infrastructural complexity. This retainer encompasses routine platform updates, bug remediation, minor stylistic adjustments, and ongoing performance assurance.

For clients seeking robust digital visibility, a specialized "Support + SEO" retainer is available. This robust package integrates fundamental monthly maintenance with deliberate search engine optimization strategies, quoted entirely bespoke to the technical footprint of your website.

Please note: While Luxie Sites deploys industry-leading practices, absolute SEO outcomes, including guaranteed or sustained immediate top-of-page rankings on any search engine, cannot be guaranteed due to the proprietary nature of third-party search algorithms.

Explicit delivery schedules are formally stipulated within the project contract.

Luxie Sites remains steadfast in our commitment to rendering deliverables within the projected timeframes. However, these timelines are contingent upon the prompt receipt of prerequisite collaterals, digital assets, and actionable feedback from the Client. Luxie Sites disclaims any liability for project delays directly attributable to the Client's failure to furnish required inputs within scheduled bounds.

In the requisite event that Luxie Sites anticipates an unavoidable delay to the developmental schedule, the Client shall be notified expeditiously, and a mutually agreeable, revised delivery deadline shall be established.

Upon the absolute realization of full and final financial settlement for the project, intellectual property rights concerning the finalized website and its directly associated digital assets shall be explicitly transferred to the Client. The extent of this transfer remains conditional upon the specific service tier selected.

• Studio Tier: Grants comprehensive ownership inclusively featuring the raw source code.
• Core, Professional, and Elite Tiers: Source files are retained securely by the Company, selectively available to the Client via an auxiliary, formalized one-time procurement fee.

Prior to the complete settlement of outstanding invoices, all architectural and design architectures formulated remain the exclusive, inalienable property of Luxie Sites and are strictly prohibited from public deployment, distribution, or commercial exploitation.

Portfolio Exhibition Rights:Luxie Sites retains the non-exclusive prerogative to feature completed executions, concepts, or derivations thereof within our professional portfolio and promotional ecosystems, barring a formal, written objection rendered by the Client explicitly prior to the contract's execution.

The incorporation of any third-party digital assets, typographic licenses, or software repositories is continuously subject to their native, respective licensing models. Luxie Sites utilizes fully compliant assets, ensuring the Client is explicitly notified regarding any specific license transfers incumbent upon the ultimate project handover.

We firmly acknowledge the paramount importance of data privacy. Both entities mutually obligate themselves to safeguard any classified intellectual data shared throughout the collaborative relationship. Such information comprehensively encompasses strategic business operations, proprietary brand mechanisms, product architectures, core customer bases, and any collateral universally designated as sensitive or "Confidential" by the participating entity.

Under no circumstance shall disclosed confidences be transmitted to extraneous third parties absent rigorous, preemptive, written authorization mandated by the disclosing party, excluding isolated instances inherently mandated by prevailing legal doctrines or regulatory enforcement.

Luxie Sites explicitly pledges never to arbitrarily aggregate, distribute, or broker sensitive Client data. Operational project assets and telecommunications are comprehensively safeguarded and utilized strictly for the localized facilitation of agreed-upon deliverables.

To the maximal boundary permissible under governing jurisdiction, the aggregate financial liability assumed by Luxie Sites against the Client—in relation to any generalized claim intersecting these Terms or the deployment of our services—shall strictly never eclipse the holistic sum of project-specific invoices paid by the Client relative to the singular claim under dispute.

Luxie Sites categorically disclaims liability for the occurrences of:

• Ancillary, inconsequential, collateral, or punitive financial losses.
• Compromised operational revenue streams, data degradation, or abstract losses in systemic business trajectories.
• Infrastructural shortfalls directly instigated by tertiary platforms, unreliably scaling host networks, or third-party fintech disruptions.
• Chronological setbacks entirely catalyzed by the lack of timely Client-driven approvals or the prolonged absence of required data.

While we deploy the highest contemporary benchmarks regarding rigorous developmental security protocols and robust algorithmic performance profiling, the unconditional structural endurance and universally unbroken operational persistence of a launched digital product cannot be inherently guaranteed, as localized endurance fundamentally relies on volatile environmental factors including external routing mechanisms, domain resilience, and localized infrastructural dependencies.

In the event of a contractual or operational dispute arising from these Terms or the provision of Luxie Sites' services, both entities fundamentally agree to prioritize mutual resolution via good-faith negotiation and immediate, direct dialogue.

Should an impasse persist beyond 14 calendar days following the verifiable delivery of a written dispute notice from either entity, the contention shall be escalated to formalized mediation. If mediation proves insufficient, the matter shall be decisively submitted to the exclusive jurisdiction of the competent courts operating within Dehradun, Uttarakhand, India.

These Terms, and the resolution of any auxiliary disputes directly arising from them, shall be exclusively governed by and judiciously construed in strict accordance with the laws of the Republic of India.

Termination by the Client: The Client retains the explicit right to summarily terminate a project at any stage via formal, written notice directed to hello@luxiesites.com. Consequent refund eligibilities shall be unilaterally assessed according to the provisions maintained within Section 04 (Refund Policy).

Termination by Luxie Sites: The Company emphatically reserves the immediate right to dissolve a project should the Client consistently neglect the provisioning of requisite materials, willfully misrepresent foundational project parameters, demand structurally illegal or aggressively unethical content, or holistically breach these Terms. Under such extreme circumstances, Luxie Sites shall strictly render a proportional refund covering only development phases not yet initiated.

Upon enacting termination, all creative, conceptual, and functional work architectures generated prior to the exact moment of dissolution remain securely within the ownership of Luxie Sites pending the complete processing of any relevant, eligible refunds.

Luxie Sites definitively reserves the unilateral right to continually update, modify, or holistically revise these Terms and Conditions. The absolute, authoritative, and current iteration will be consistently maintained and publicly listed at luxiesites.com/terms.

Material adjustments fundamentally altering active agreements will be officially communicated to currently enrolled, active clientele via verified email channels a minimum of 7 calendar days prior to operational enactment. The continued contractual engagement with Luxie Sites following the proactive posting of augmented Terms inherently constitutes incontrovertible acceptance of all instituted revisions.
