Introduction

Welcome to Luxie Sites ("we," "our," or "the Company"). These Terms and Conditions govern all web design and development services provided by Luxie Sites to clients ("you" or "the Client"). By engaging our services, making any payment, or submitting any brief form, you confirm that you have read, understood, and agreed to be bound by these Terms in their entirety.

Luxie Sites is a premium web design and development consultancy operating under the direction of Piyush Arya, Dehradun, India. Our services are available to clients in India and internationally.

These Terms constitute the complete and exclusive agreement between Luxie Sites and the Client with respect to each project, superseding any prior communications, proposals, or understandings, whether written or oral.

Services Offered

Luxie Sites provides premium website design and development services across the following tiers. Each project begins with a consultation call (₹99) to scope requirements before any development work commences.

The Bespoke package includes complete source file delivery and full intellectual property transfer upon project completion. For all other packages (Basic, Pro, Premium), the delivered website is fully yours to publish and use — source code access requires a separate one-time fee; please email luxiesites@gmail.com to enquire. Hosting is not included in any package but guidance is provided at no extra cost.

For international clients, services are provided on a custom-quote basis following a free enquiry submission. Pricing and scope are agreed in writing before work commences.

Pricing & Payment

All prices are displayed and charged in Indian Rupees (INR) unless otherwise agreed in writing for international projects.

Payments are processed securely via Razorpay. The Client receives a payment confirmation and is redirected to the relevant brief form immediately after successful payment. All payments are in INR unless otherwise agreed.

For international clients, payment methods and currency will be agreed prior to project commencement and documented in the project proposal.

All delivery timelines begin only after: (a) the consultation call has taken place, and (b) the completed brief form has been received by Luxie Sites. Luxie Sites reserves the right to request a deposit on larger Bespoke projects; this will be communicated and agreed before work begins.

Refund Policy

Luxie Sites operates a transparent, stage-based refund policy tied to the progress of your project. Refund eligibility is determined by where the project stands at the time the request is submitted.

The determination of which stage a project is in at the time of a refund request rests with Luxie Sites, and will be communicated transparently to the Client together with a summary of work completed.

For Stage 2 refunds, the exact percentage (between 20% and 50%) is calculated based on the proportion of the agreed deliverables that remain unfinished at the time of the cancellation request. This assessment will be shared with the Client in writing before the refund is processed.

All refund requests must be submitted in writing to luxiesites@gmail.com. Luxie Sites will acknowledge all requests within 2 business days and resolve them within 7 business days of acknowledgement.

Revision Policy

Each package includes a set number of revision rounds. A revision round is defined as one consolidated set of feedback submitted by the Client, addressed by Luxie Sites in a single pass. Revision rounds are not cumulative and must be requested within the agreed project timeline.

Revision requests that constitute a material change to the agreed project scope — such as adding new pages, changing the core concept, or requesting functionality not scoped during the consultation — may be treated as change requests and quoted separately.

For the Bespoke tier, "unlimited revisions" applies within the scope agreed on the consultation call. Changes that fall outside the agreed scope are subject to separate quotation.

Post-Delivery Support

Each package includes a post-launch support window during which Luxie Sites will address minor bugs, display issues, or technical errors at no additional charge.

Support windows apply from the date of site launch (go-live), not the date of delivery of files. After the support window expires, ongoing maintenance or changes may be quoted as a separate service.

Support does not include adding new pages, redesigning existing sections, or implementing new features beyond the original project scope. These will be treated as new projects or change requests.

Delivery Timeline

Luxie Sites will make every effort to meet agreed delivery dates. However, timelines may be affected by delays in receiving required content, assets, or feedback from the Client. Luxie Sites accepts no liability for delays caused by the Client's failure to provide required materials in a timely manner.

In the event that Luxie Sites anticipates a delay beyond the agreed timeline, the Client will be informed promptly and a revised delivery date will be agreed.

Ownership & Intellectual Property

Upon receipt of full and final payment for the project, the Client receives ownership of the delivered website and all associated design assets. The scope of intellectual property transfer varies by package as follows:

• Bespoke package: Complete and unconditional transfer of all deliverables, including full source files (HTML, CSS, JavaScript, and all project files), design assets, and written content produced by Luxie Sites. No royalties, no recurring fees, no lock-in.
• Basic, Pro, and Premium packages: Full ownership of the live website and all design assets. Source code access is available for an additional one-time fee — please contact luxiesites@gmail.com to enquire about source file licensing.

Until full payment has been received, all work product remains the intellectual property of Luxie Sites and must not be published, distributed, or used commercially.

Portfolio rights: Luxie Sites reserves the right to display completed projects in its portfolio and marketing materials unless the Client requests otherwise in writing prior to project commencement. This right continues even after all client payments are complete.

Third-party assets, fonts, or libraries used in the project remain subject to their respective licences. Luxie Sites will use only appropriately licensed materials and will inform the Client of any licence obligations that transfer to them on delivery.

Confidentiality

Both parties agree to treat all information shared during the course of the project as confidential. This includes, but is not limited to: business strategies, branding details, product information, customer data, and any materials marked as confidential by either party.

Confidential information shall not be disclosed to any third party without the prior written consent of the disclosing party, except where disclosure is required by law or regulation.

Luxie Sites will never sell, share, or distribute client data to third parties. All project files and client communications are retained securely and used solely for the purpose of delivering the agreed services.

Limitation of Liability

To the maximum extent permitted by applicable law, Luxie Sites' total liability to the Client for any claim arising out of or in connection with these Terms or the services provided shall not exceed the total fees paid by the Client for the specific project in dispute.

Luxie Sites shall not be liable for any:

• Indirect, incidental, or consequential losses
• Loss of revenue, data, or business opportunity
• Losses arising from third-party platform failures (hosting providers, payment processors, etc.)
• Delays caused by the Client's failure to provide required materials or approvals

While Luxie Sites employs best practices in security and performance, we cannot guarantee uninterrupted or error-free operation of any delivered website, as this depends on factors outside our control including hosting, domain configuration, and third-party services.

Dispute Resolution

In the event of a dispute arising out of or in connection with these Terms or any services provided by Luxie Sites, both parties agree to first attempt to resolve the matter through good-faith negotiation and direct communication.

If a dispute cannot be resolved through negotiation within 14 calendar days of written notice from either party, the matter shall be referred to mediation or, if necessary, to the courts of competent jurisdiction in Dehradun, India.

These Terms and any disputes arising from them shall be governed by and construed in accordance with the laws of India.

Termination

Termination by Client: The Client may terminate a project at any time by providing written notice to luxiesites@gmail.com. Refund eligibility will be assessed per the Refund Policy (Section 04).

Termination by Luxie Sites: Luxie Sites reserves the right to terminate a project if the Client repeatedly fails to provide required materials, misrepresents project details, requests illegal or unethical content, or breaches these Terms. In such cases, Luxie Sites will refund fees proportional to work not yet commenced.

Upon termination, all work product created up to the point of termination remains the property of Luxie Sites until any applicable refund has been processed.

Changes to Terms

Luxie Sites reserves the right to update or revise these Terms and Conditions at any time. The most current version will always be available at luxiesites.netlify.app/termsandconditions.

Material changes will be communicated to active clients via email at least 7 days before taking effect. Your continued engagement of Luxie Sites services after the posting of revised Terms constitutes your acceptance of those changes.
